• Third-Party Compliance: When utilizing our web scraping or data collection services, clients are responsible for ensuring that the requested data extraction complies with the target website's Terms of Service and applicable laws.

3. Client Obligations

As a client of Data Tune, you agree to:

• Provide accurate, complete, and timely information required for us to execute your project.
• Ensure you have the legal right to request the scraping, processing, or mining of the data you direct us toward.
• Not use our services for illegal, unethical, or malicious purposes, including but not limited to unauthorized access to protected systems, DDoS attacks, or the theft of personally identifiable information (PII).

4. Intellectual Property

Methodologies and Infrastructure: All algorithms, scripts, hardware prototypes, APIs, and proprietary pipelines developed by Data Tune remain the exclusive intellectual property of Data Tune, unless explicitly transferred in writing.

Deliverables: Upon full payment for a project, you retain full ownership of the final dataset, intelligence report, or structured database delivered to you as part of the service agreement.

5. Payment Terms

Payment terms for specific services (Tier 1, Tier 2, Tier 3) are detailed on our pricing pages and finalized in your service contract. Fees may be billed as one-time project costs, material costs (for IoT hardware), or monthly retainers. Failure to remit payment may result in the suspension of automated data pipelines or withholding of final deliverables.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Data Tune, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the services.
• Any conduct or content of any third party on the services.
• Business decisions or predictive models built upon the datasets provided by Data Tune.

7. Termination

We may terminate or suspend access to our service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the service will immediately cease, and outstanding balances for work completed will become immediately due.

8. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms.
